Firm aims to overturn Tesco sale

AN investment company is so incensed by the sale of Penistone recreation ground that it's making an application to the High Court to try to overturn the council's decision to dispose of the land.

Yorkshire Land Limited says the ground, part of which is public open space, should be kept for the growing needs of the community and if it is sold compensatory land should be provided.

Yorkshire Land owns some land adjacent to the recreation ground which it offered to the council to counteract the loss of open space.

But the land was sold to Tesco and Dransfield Properties in November last year, with no alternative land being provided or assessment of community needs.

Yorkshire Land and dozens of angry residents sent letters of objection to the council in relation to the disposal of land to the rear of Market Street, which were considered at a cabinet meeting in February, although the sale had already been agreed.

At the meeting it was decided that the issues raised 'would not justify departing from the decision to authorise the implementation of the Penistone Town Centre Redevelopment Scheme including the disposal of the land'.

There has been two applications to get the land designated as a village green, which would ensure that it would not be built on in future. The planning board refused both applications.

Yorkshire Land is also appealing against 'ineffective advertising' and the 'lack of proper regard for objections'.
